Your Privacy Rights

Depending on your state of residency, you may have certain rights related to your Personal Information, including:

  • Access and Data Portability. You may confirm whether we process your Personal Information and access a copy of the Personal Information we process. Depending on your state, you may have the right to receive additional information and it will be included in the response to your access request.
  • Correction. You may request that we correct inaccuracies in your personal data that we may maintain, taking into account the information's nature and processing purpose.
  • Deletion. You may request that we delete personal data about you that we maintain, subject to certain exceptions under applicable law.
  • Opt Out of Personal Data for Targeted Advertising, Profiling, and Sales. You may request that we do not use your personal data for these purposes.

The exact scope of these rights vary by state. There are also exceptions where we may not have an obligation to fulfill your request. If you are a California resident, additional information applies to you. See below "Your California Privacy Rights" for more information.

To exercise any of these rights or appeal a decision regarding a consumer rights request, email us at info@catyears.com.

Some browsers and browser extensions support the Global Privacy Control ("GPC") that can send a signal to process your request to opt out from certain types of data processing, including data "sales" as defined under certain laws. When we detect such a signal, we will make reasonable efforts to respect your choices indicated by a GPC setting as required by applicable law.

Your California Privacy Rights

For California Residents:

The chart below identifies the categories of personal information we collected from our consumers within the last 12 months:

[CHART TO BE INSERTED — CCPA categories of personal information collected in the last 12 months. The source document references this chart but does not include it. Get from counsel before publishing.]

If you are a California resident, you have the rights outlined in this section. In order to exercise these rights, please see the "Exercising Your Rights" section below. If there are any conflicts between this section and any other provision of this Policy and you are a California resident, the portion that is more protective of your Personal Information shall control. Any questions about this section should be sent to us at info@catyears.com.

(a) Right of Access

You have the right to request that we disclose certain information to you about our collection and use of your Personal Information (the "right to know"), including the specific pieces of Personal Information we have collected about you (a "data portability request"). We will provide you with the following information covering the last 12 months:

The categories of:

  • Personal Information we collected about you; and
  • sources from which we collected your Personal Information.

The business or commercial purpose for collecting your Personal Information and, if applicable, selling or sharing your Personal Information.

If applicable, the categories of persons, including third parties, to whom we disclosed your Personal Information, including separate disclosures identifying the categories of your Personal Information that we:

  • disclosed for a business purpose to each category of persons; and
  • sold or shared to each category of third parties.

If we have disclosed your Personal Information for a business purpose over the past 12 months, we will identify the categories of Personal Information shared with each category of third-party recipients.

(b) Right of Deletion

You have the right to request that we delete the Personal Information that we have collected from you. Once we receive your request and confirm your identity, we will delete your personal information unless an exception allows us to retain it. Under the CCPA, this right is subject to certain exceptions: for example, we may need to retain your Personal Information to provide you with the Services or complete a transaction or other action you have requested. If your deletion request is subject to one of these exceptions, we may deny your deletion request. We will also notify our service providers, and other recipients to take appropriate action.

(c) Right to Correct

You have a right to request correction of inaccurate Personal Information. We may require you to provide documentation, if needed, to confirm your identity and support your claim that the information is inaccurate. Unless an exception applies, we will correct personal information and notify our service providers, and other recipients to take action.

(d) Right to Limit

You have a right to limit use and disclosure of your Personal Information only to what is necessary to perform the Services.

(e) Right to Opt-Out of Selling Your Personal Information

You have the right to request that businesses stop selling or sharing your Personal Information at any time (the "right to opt-out").

Under the CCPA, "sharing" is defined as the targeting of advertising to a consumer based on that consumer's Personal Information obtained from the consumer's activity across distinct online services, and "selling" is defined as the disclosure of Personal Information to third parties in exchange for monetary or other valuable consideration. These definitions are very broad. While we have not sold Personal Information for any monetary value, we "share" information with our advertising partners to provide more relevant and tailored advertising to you regarding our Services. Moreover, our use of third-party analytics services and online advertising services may result in the sharing of online identifiers (e.g., cookie data, IP addresses, device identifiers, and usage information) in a way that may be considered a "sale" under the CCPA.

You can request to opt-out of sharing your Personal Information as defined above by emailing us at info@catyears.com.

You may also exercise your right to opt-out by clicking the "Do Not Sell or Share My Personal Information" link available on our website footer.

(f) Right to Appeal

If we deny your privacy request, you have the right to appeal our decision. To submit an appeal, please contact us at info@catyears.com. We will review and respond to your appeal within the time frame required by law.

(g) Non-Discrimination for Exercising Your CCPA Rights

We will not discriminate against you for exercising your rights under the CCPA. We will not deny you our goods or services, charge you different prices or rates, or provide you a lower quality of goods and services if you exercise your rights under the CCPA.

(h) Right to Opt-Out of Automated Decision-Making Technology (Profiling)

You can request to opt-out of automated decision-making or profiling as defined above by emailing us at info@catyears.com or using this preference form link to opt-out.

(i) Exercising Your Rights

To exercise the rights described above, you must send us a request with sufficient detail so we can properly understand, evaluate, and respond to it, including sufficient information to allow us to verify that you are the person about whom we have collected Personal Information. Each request that meets this criteria will be a "Valid Request." If the request does not meet this criteria, we may not respond. You do not need an account to submit a Valid Request.

We will work to respond to your Valid Request within 45 days of receipt. There is no charge associated with Valid Requests unless it is excessive, unfounded or repetitive. We will notify you if we believe a fee is required.

A Valid Request can be submitted via contacting us at info@catyears.com.

Other State Law Privacy Rights

Under California Civil Code Sections 1798.83-1798.84, California residents are entitled to contact us to prevent disclosure of Personal Information and information to third parties for such third parties' direct marketing purposes; in order to submit such a request, please contact us at info@catyears.com.

Your browser may offer you a "Do Not Track" option, which allows you to signal to operators of websites and web applications and services that you do not wish such operators to track certain of your online activities over time and across different websites. Our Services do not support Do Not Track requests at this time. To find out more about "Do Not Track," you can visit www.allaboutdnt.com.

Residents of Colorado, Connecticut, Delaware, Iowa, Maryland, Minnesota, Montana, Nebraska, Nevada, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, and Virginia may have similar rights to those described for California residents. We will honor applicable state privacy rights to the extent required by law.

Cookies and Other Tracking Technologies

We may use various methods and technologies to store or collect Usage Information ("Tracking Technologies"). The data collected by the Tracking Technologies includes, but is not limited to, User ID, IP Address, User Agent, Date/Timestamp, Referral URL, Request URL, Review Submission ID, Client Name or ID, Product Category ID, Product ID, Website Category, Session ID, Click Events, Conversions, Site Visits, Average Time on Site, and other data passively generated by a user's interaction with the Site.

Tracking Technologies may set, change, alter, or modify settings or configurations on your Device.

To learn more, you may review our Cookie Policy.

Please also note that while we do not store Personal Information directly, services such as our web hosting service and our payment processor may use cookies and process data as part of our store's functionality. We are not responsible for their use of your data or their use of cookies.

Shopify

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you. Your data is stored through Shopify's data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.

(a) Shopify Payment

If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover.

PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

For more insight, you may also want to read Shopify's Terms of Service (https://www.shopify.com/legal/terms) or Privacy Statement (https://www.shopify.com/legal/privacy).

  • cart — unique token, persistent for 2 weeks. Stores information about the contents of your cart.
  • _secure_session_id — unique token, sessional.
  • storefront_digest — unique token, indefinite. If the shop has a password, this is used to determine if the current visitor has access.

You can unsubscribe from our marketing emails via the unsubscribe link provided in the emails or by emailing us at info@catyears.com. If you receive an unwanted SMS or text message from us, you may reply STOP or contact us at info@catyears.com to opt-out of receiving future messages. Even if you opt-out from receiving marketing messages from us, you will continue to receive administrative messages from us, such as order confirmations, updates to our policies and practices, or other communications directly relating to your use of the Services, and you cannot opt-out from receiving those messages.

Aggregated Information

We may aggregate, de-identify, and/or anonymize any information collected through the Website or Services such that such information is no longer linked to your personally identifiable information. We may use and share this aggregated and anonymized information (non-Personal Information) for any purpose, including without limitation, for research and marketing purposes and may also share such data with our affiliates and third parties, including advertisers, promotional partners, and others.

Your Rights and Choices About the Personal Information We Collect

For example, we may retain Personal Information about a user for legitimate business purposes, if it may be necessary to prevent fraud or future abuse, for account recovery purposes, if required by law, or as retained in our data backup systems or cached or archived pages. All retained Personal Information will continue to be subject to the terms of the Privacy Policy to which the user has previously agreed.
